Could Federline Actually Win Custody?

Kevin Federline’s child custody filing may seem ridiculous to most outsiders, but closer examination of the facts reveal that this is far from a cut-and-dry case.  Here are several factors that could ultimately swing the case into Federline’s favor.

Child Safety
One of the foremost considerations in a child custody hearing is the safety of the children.  Britney Spears has a documented history of questionable decision making involving the care of her children.  If the Federline camp can prove that the children are in danger while in custody with Ms. Spears, then the momentum will quickly shift to the Federline side.

Substance Abuse
Neither Spears nor Federline are known for their abstinence, but it is Spears who has let her partying ways become much too public.  She is regularly photographed in the early hours of the morning, speeding off from one club to another.  Combine this with questions regarding her prescription drug use, and suddenly there is reason for concern.  This consistent display of questionable behavior could raise doubts about Spears capacity as a mother.

Financial Support
In order for Kevin Federline to win child custody, he will have to prove his own financial stability, but this may not be as difficult as many think.  With a handful of endorsement and acting deals, along with his continued experiment into music recording, Federline clears more than enough to provide a stable living for his children.  Remember, he only has to prove that he is earning enough to provide for the average family.  It is the child support hearing that determines what standard of living the kids should assume and how much each parent is responsible for.

Witnesses
Unsubstantiated claims are a big no-no in court.  You need to come prepared with proof that what you say is true.  The Federline camp is working hard at building evidence in their custody battle against Britney Spears.  Numerous petitions have already been served to former employees and friends of Spears.  It is obvious that Federline is confident that he can substantiate his claims against Spears with the combination of witness accounts and documentation.

The Bottom Line
While women still hold a slight advantage in winning child custody over men, the Federline vs. Spears case has enough extenuating circumstances to make it a close decision.  While both parents are involved in fast-paced Hollywood lifestyles, it is Spears who has continually found herself in embarrassing predicaments.   If these blunders are manipulated tactfully by Federline’s lawyers, then no amount of money will help Britney Spears win back her kids.
